Ratcliff lawyers successfully applied on behalf of five Nuu-chah-nulth First Nations for an injunction blocking the opening this year of a herring fishery on the west coast of Vancouver Island.
The Ahousaht, Ehattesaht, Hesquiaht, Mowachaht/Muchalaht, and Tla-o-qui-aht First Nations on Vancouver Island, who had been found to have an Aboriginal right to sell fish in the Ahousaht litigation (Ahousaht Indian Band and Nation v. Canada (Attorney General), 2010 BCSC 1552 & 2013 BCCA 300), instructed Ratcliff & Co to seek the injunction after Minister Gail Shea decided to open a herring fishery on the west coast of Vancouver Island for the first time in a decade.
